1. Introduction
Welcome to Amtaar (“Company”, “we”, “us”, or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our platform, mobile application, and related services (collectively, the “Platform”). By registering for an investor account or purchasing a fractional property investment through Amtaar, you agree to be bound by these Terms. Please read these Terms carefully before investing. If you do not agree, you may not use or access our Platform.
2. Definitions
- “Fractional Investment” means the purchase of an equity share representing fractional ownership in a specific property owned or managed by Amtaar.
- “Investor” or “User” means any individual or legal entity that registers with Amtaar to make investments.
- “Property” refers to any real estate asset available for investment on the Platform.
- “Rental Payout” refers to the periodic distribution of rental income to Investors based on their ownership fraction.
- “KYC” means Know Your Customer verification, required to comply with anti-money laundering (AML) laws in Egypt.
3. Eligibility
- You must be at least 21 years old and legally capable of entering into binding contracts under Egyptian law.
- You must successfully complete all KYC and AML checks as required by Egyptian financial regulations before making any investment.
- Investments are limited to properties located in Egypt and offered through the Amtaar Platform.
4. Nature of Investment
- By investing through Amtaar, you are purchasing equity ownership in a property.
- Your ownership is fractional, meaning you share proportionate ownership rights, benefits, and responsibilities with other investors in the same property.
- The minimum investment amount is EGP 50,000.
- Your investment entitles you to receive rental payouts in proportion to your ownership share, subject to actual property performance and occupancy.
5. Rental Income Distribution
- Rental income generated from the property will be distributed to investors on a pro-rata basis, according to their ownership share.
- Amtaar does not guarantee rental income, as it depends on actual property performance and contract status.
- All payouts will be made to the Investor’s registered bank account or digital wallet as specified in their Amtaar account.
- Amtaar reserves the right to adjust payout schedules in cases of delayed rent collection, maintenance, or unforeseen property-related issues.
6. Fees and Taxes
- Amtaar may charge management fees, transaction fees, or administrative fees as disclosed in the investment offer documents for each property.
- Investors are responsible for any applicable taxes on income or capital gains arising from their investments, as required under Egyptian tax law.
7. Exit, Resale, and Holding Period
- Each investment carries a minimum holding period of one (1) year from the date of purchase.
- After the holding period, investors may resell or transfer their ownership fraction through the Amtaar Platform or via private sale, subject to Amtaar’s approval and applicable fees.
- Amtaar may facilitate secondary trading but does not guarantee liquidity or resale opportunities.
8. Risks and Disclaimers
- Fractional real estate investments carry risks including, but not limited to, property devaluation, market fluctuations, rental defaults, and liquidity limitations.
- Past performance is not indicative of future results.
- Investors acknowledge that Amtaar and its affiliates are not financial advisors and that all investment decisions are made at the Investor’s own risk.
- Amtaar shall not be held liable for any losses arising from market conditions, property performance, or investor decisions.
9. Data Protection and Privacy
- Amtaar collects and processes user data in compliance with the Egyptian Data Protection Law No. 151 of 2020.
- Collected information includes identity documents, contact details, payment information, and investment history.
- Amtaar implements appropriate technical and organizational security measures to protect personal data.

10. Account Management
- Investors are responsible for maintaining the confidentiality of their login credentials.
- Any actions performed under an investor’s account are deemed to have been authorized by that investor.
- Amtaar reserves the right to suspend or terminate accounts suspected of fraudulent, illegal, or non-compliant activity.
11. Limitation of Liability
- Amtaar shall not be liable for indirect, incidental, or consequential damages, including loss of income or opportunity, resulting from the use of the Platform or participation in any investment.
- The Company’s total liability shall in no case exceed the total amount of fees paid by the Investor to Amtaar in the preceding twelve (12) months.
12. Termination
- Amtaar may suspend or terminate your account at any time for breach of these Terms or violation of applicable laws.
- Upon termination, all outstanding investments and payouts will be processed in accordance with applicable property ownership terms.
13. Amendments
- Amtaar reserves the right to modify or update these Terms at any time.
- Updated versions will be made available on the Platform, and continued use after changes constitutes acceptance of the new Terms.
14. Governing Law and Dispute Resolution
- These Terms shall be governed by and construed in accordance with the laws of the Arab Republic of Egypt.
- Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Cairo, Egypt.
